A favourable ruling will eliminate all of the Underwriters remaining defences and decide all of the final elements of Nautronix' breach of contract claim except for the amount of damages, according to the Fremantle-based marine services company. Nautronix' legal team put the chances of a favourable ruling above 80 per cent.

The San Diego court has set 8 March as the hearing date for the summary judgement motion. The company expects all aspects of the litigation and damage assessment will be concluded by the end of this year.

Last year, Nautronix lost a legal battle against SDS Corporation in relation to patent infringement by two of its subsidiaries, Azuko Pty Ltd and Seismic Supply International Pty Ltd.
